E. Jean Carroll is thinking about suing Donald Trump for defamation for a third time for repeatedly trashing her during a Wednesday night CNN town hall, her lawyer told the New York Times.
"Everything's on the table, obviously, and we have to give serious consideration to it," Carroll's lawyer, Roberta Kaplan told the Times. "We have to weigh the various pros and cons and we'll come to a decision in the next day or so, probably."
During the 70-minute-long CNN event, Trump called her allegations of sexual abuse "fake" and a "made-up story." The audience laughed.
A Manhattan jury on Tuesday found Trump was liable for sexually abusing Carroll in 1996. It also found him liable for defaming her when he called her a liar years later, and awarded her a total of $5 million in damages.
Trump's attorneys filed a document on Thursday indicating they were appealing the verdict. Asked Thursday if he was concerned by the prospect of additional defamation lawsuits from Carroll following Trump's comments on CNN, Tacopina answered in the negative.
"No, I am not," Tacopina said in a text message to Insider.
During the trial, US District Judge Lewis Kaplan (who is unrelated to Carroll's lawyer) warned Tacopina about comments made by Trump and his son Eric on social media sites attacking Carroll. Carroll's attorneys expressed concern that the comments may intimidate jurors as they listened to in-court testimony.
Trump appeared to take a step back from publicly attacking Carroll, not mentioning her during a campaign rally in New Hampshire during the first week of the trial.
By the end of the trial, he had changed tack. On Tuesday, the day of jury deliberation, Trump falsely said in Truth Social posts that he wasn't permitted to testify in the case. Jude Kaplan, in fact, offered unusually wide latitude to allow Trump to testify in person. Kaplan said prior to the trial that he would order the US Marshals Service to help arrange security concerns if needed, and he offered Trump's lawyers a chance to reopen the case after they already rested his defense.
Jurors heard from Trump only through 48 minutes' worth of deposition video, where he continued to deny knowing who Carroll was, even though he was friends with her boss and they were photographed together several years before the sexual assault.

On Wednesday night, Trump let loose, insulting Carroll in front of a cheering crowd.

"I am upset on the behalf of young men in America," Carroll told the Times. "They cannot listen to this balderdash and this old-timey view of women, which is a cave-man view."

Carroll's attorney didn't immediately respond to Insider's request for comment.

Unlike a lot of people here, I don’t think CNN made a mistake in doing that town hall with Donald Trump. Like it or not, he is the Republican frontrunner, and it would have been malpractice not to give him airtime. Whether or not it should have been an unfettered platform is quite another matter. For instance, it was utterly disgraceful that the town hall was allowed to continue after Trump belittled and insulted Kaitlan Collins the way he did.
But it did do us a favor in a lot of respects. For one thing, just about everyone who doesn’t have a MAGA hat glued to his or her head saw why Trump was the most unfit and unqualified president in our nation’s history, and why he must never be allowed to hold power again. For another, he may have literally talked himself into more legal peril on several fronts. One such front is E. Jean Carroll, who just wrung $5 million out of Trump for sexually assaulting her in the 1990s and defaming her. She told The New York Times that in the wake of his claims on Wednesday night that, among other things, he’d been the victim of “a rigged deal” from Carroll, whom he called a “wack job,” she’s thinking about filing another defamation suit against him.



Carroll said she went to bed before Trump took the stage on CNN, but read a transcript of his comments provided by her lawyer, Roberta Kaplan. She only needed to read one paragraph before recoiling in disgust.
“It’s just stupid, it’s just disgusting, vile, foul, it wounds people,” Ms. Carroll said in an interview with The New York Times, adding that she had been “insulted by better people.”
Ms. Carroll said she had been infuriated when her longtime stylist told her that her 15-year-old son was talking about what Mr. Trump had said.
“I am upset on the behalf of young men in America,” Ms. Carroll said. “They cannot listen to this balderdash and this old-timey view of women, which is a cave-man view.”
Kaplan said that a fresh lawsuit hasn’t been ruled out—and a decision on that front should come very quickly.
On Thursday, Ms. Kaplan said no decision had been made on whether a new defamation suit would be filed in light of Mr. Trump’s latest comments.

Oh, I hope Carroll does sue—and gets a chance to repeat the dose she gave Trump earlier this week. It would actually be the third time Carroll has sued Trump; her original suit from 2019 is still wending its way through the appeals process because Trump claims that any comments he made about her at the time were in his official capacity as president.
Past history suggests Carroll would have a considerable advantage at this trial. According to MSNBC’s Danny Cevallos, Carroll was swimming upstream until Kaplan deposed Trump for the first defamation suit. It was a litany of unforced errors—mistaking Carroll for Marla Maples, claiming neither Carroll nor Kaplan were his “type,” and defending the “Access Hollywood” tape. For that reason, Cevallos said that for all intents and purposes, Trump talked himself into coughing up $5 million. Expect more of the same if Trump is deposed again.
